The Basic Conditions of Employment Act (BCEA) entitles every employee in KwaZulu-Natal to minimum paid leave. If your employer refuses your lawful leave or fails to pay leave pay, you can claim through the CCMA or the Department of Employment and Labour.
Step 1. Check your employment contract and company leave policy against the BCEA minimums — the contract may not give you less than the BCEA minimum.
Step 2. Submit your leave request in writing and keep a copy.
Step 3. If leave is refused, request the reason in writing. Employers may schedule leave in some circumstances but cannot deny the entitlement.
Step 4. If leave pay was not paid on resignation or dismissal (leave pay accrues and must be paid out), send a formal written demand.
Step 5. Lodge a complaint with the Department of Employment and Labour (Basic Conditions of Employment Inspector) in KwaZulu-Natal.
Step 6. Alternatively, refer an unfair labour practice dispute to the CCMA within 90 days.
