Every child in Western Cape has a constitutional right to a basic education. Public schools may not refuse admission on the basis of language, religion, race, disability, or inability to pay school fees. If your child is refused admission unlawfully, you can appeal to the Western Cape Department of Education.
Step 1. Submit a written application to the school and keep a copy. Note the date of submission.
Step 2. If refused, request the reasons for refusal in writing from the principal or SGB.
Step 3. If the reason is unlawful (race, language, inability to pay fees, disability), lodge a written appeal to the Western Cape Department of Education within 7 days.
Step 4. The MEC for Education must provide a place within 15 days of a valid appeal.
Step 5. If the Department fails to act, apply to the Equality Court or High Court for an order compelling admission.
Step 6. Contact the South African Human Rights Commission (SAHRC) for free assistance if the refusal constitutes discrimination.
