Pension and provident fund disputes are common in North West. Your employer is legally obligated to pay contributions to the fund. If they fail to do so, or if the fund refuses your withdrawal benefit, the Pension Funds Adjudicator provides free dispute resolution.
Step 1. Obtain a benefit statement from your fund and compare it to your payslips — check that contributions deducted were actually paid over to the fund.
Step 2. Lodge a complaint in writing with the fund trustees, specifying the dispute and requesting resolution within 30 days.
Step 3. If the fund does not resolve it, lodge a complaint with the Pension Funds Adjudicator at 012 346 1738 or pfa.org.za — the service is free.
Step 4. The Adjudicator can compel the fund or employer to pay contributions and impose penalties.
Step 5. If your employer failed to register you for the fund at all, report the matter to the Financial Sector Conduct Authority (FSCA).
