Pension Fund Dispute in Free State

The Law That Protects You

What To Do — Step by Step

  1. Step 1. Obtain a benefit statement from your fund and compare it to your payslips — check that contributions deducted were actually paid over to the fund.

  2. Step 2. Lodge a complaint in writing with the fund trustees, specifying the dispute and requesting resolution within 30 days.

  3. Step 3. If the fund does not resolve it, lodge a complaint with the Pension Funds Adjudicator at 012 346 1738 or pfa.org.za — the service is free.

  4. Step 4. The Adjudicator can compel the fund or employer to pay contributions and impose penalties.

  5. Step 5. If your employer failed to register you for the fund at all, report the matter to the Financial Sector Conduct Authority (FSCA).

Frequently Asked Questions

Can I access my pension fund before retirement in Free State?
You may access your full benefit on resignation, dismissal, or retrenchment (for provident funds) or a portion for pension funds. Tax is deducted at source. Early withdrawal permanently reduces your retirement benefit.
My employer deducted pension contributions but never paid them over — what happens in Free State?
