Name Change Rights in Eastern Cape

Any South African citizen or permanent resident in Eastern Cape can apply to change their first name or surname through the Department of Home Affairs. The process is straightforward and low-cost. Name changes may also be ordered by a court in cases of gender confirmation.

The Law That Protects You

Births and Deaths Registration Act 51 of 1992 — Section 24
A person may apply to the Director-General to have their first name changed. The application must be accompanied by the prescribed fee and documentation.
Alteration of Sex Description and Sex Status Act 49 of 2003 — Section 2
A person whose sexual characteristics have been altered by surgical or medical treatment may apply to have their sex description and forenames changed on the birth register.

What To Do — Step by Step

  1. Step 1. Visit your nearest Home Affairs office in Eastern Cape with your original South African ID, birth certificate, and proof of address.

  2. Step 2. Complete Form DHA-9 (Change of First Names) or Form DHA-29 (Change of Surname). Forms are available at the office.

  3. Step 3. Pay the prescribed fee (currently R75 for first name change; surname changes may differ).

  4. Step 4. For a first name change, the new name will be noted on your ID. You may need to apply for a new Smart ID Card with the changed name.

  5. Step 5. For gender-affirming name changes under the Alteration of Sex Description Act, medical documentation from your treating doctor or psychologist is required.

  6. Step 6. After the change, update your name with SARS, your bank, SASSA (if applicable), your employer, and the deeds registry if you own property.

Frequently Asked Questions

Can I change my surname without getting married or divorced in Eastern Cape?
Yes. You can apply to change your surname independently of marital status. The Director-General may refuse if the proposed surname is offensive, contrary to public interest, or already in use in a way that could cause confusion.
How many times can I change my first name in Eastern Cape?
The law allows a person to change their first name once in their lifetime under section 24 of the Births and Deaths Registration Act, unless a court orders otherwise or the change is related to a gender status change.
Does a name change affect my criminal record in Eastern Cape?
No. A name change does not expunge or affect any criminal record, debt judgments, or other legal obligations. Your previous name is linked to your ID number, and records can be traced across name changes.
