Ethnic and tribal discrimination in employment is a serious issue in Zambia, particularly in family-owned businesses and in politically connected institutions. Employers sometimes openly prefer to hire from their own ethnic group. Article 23 of Zambia's Constitution prohibits discrimination based on tribe, race, and place of origin. The Employment Code Act 2019 reinforces this in the employment context. The ZHRC and Labour Commissioner both accept complaints.

Community Cohesion as Discrimination Justification Fallacy

The employer frames ethnic discrimination as a benign desire for community cohesion. This is a rationalisation. Excluding a qualified applicant because of their tribe — not their qualifications, character, or suitability for the role — is discrimination. No business interest in cultural homogeneity overrides the constitutional prohibition on tribal discrimination.

Constitution of Zambia 1991 (as amended)
“No law shall make any provision that is discriminatory either of itself or in its effect, and no person shall be treated in a discriminatory manner, on the grounds of race, tribe, sex, place of origin, marital status, political opinions, colour or creed.”
Refusing employment on the basis of tribe is direct discrimination under Article 23. This is a constitutional violation you can raise with the ZHRC.
Employment Code Act No. 3 of 2019
“An employer shall not discriminate against any person in respect of employment, training, or promotion on the grounds of tribe, race, sex, disability, pregnancy, or HIV/AIDS status.”
Refusal to hire based on tribe is a prohibited discriminatory employment practice. File a complaint with the Labour Commissioner alongside the ZHRC complaint.

God's Word on This

Acts 10:34-35 (NIV)
“Then Peter began to speak: 'I now realise how true it is that God does not show favouritism but accepts from every nation the one who fears him and does what is right.'”
God's standard for acceptance is character and conduct — not tribe. An employer who discriminates by tribe is applying a standard that God himself explicitly rejected. Your worth and qualification are not diminished by your ethnic origin.
