Denied Access to a Public Service Because of Disability
A person with a disability is refused service or access to a public facility

The Situation
What They Said
“We can't serve you here — our facility isn't set up for people like you.”
Discrimination against persons with disabilities in accessing public services, employment, and education is widespread in Zambia. The Persons with Disabilities Act 2012 and the Constitution both protect the rights of persons with disabilities. Refusing service or access solely because of disability — without reasonable efforts to accommodate — is unlawful. The ZHRC investigates disability discrimination complaints.
The Fallacy
Infrastructure Deficiency as Rights Waiver Fallacy
The service provider implies that their own failure to make reasonable accommodation justifies refusing service. This reversal is unlawful. The obligation to provide reasonable accommodation lies on the service provider — not on the person with a disability. The person's rights are not contingent on the provider having already made all necessary adjustments. Lack of current accommodation is a violation to be remedied, not a reason to refuse service.
What the Law Says
Your Legal Foundation
Persons with Disabilities Act No. 6 of 2012
Section 21 — Right to Access Public Services
“Every person with a disability has the right to access public services, facilities, and programmes without discrimination, and service providers shall make reasonable adjustments to accommodate persons with disabilities.”
Refusing access because of disability is unlawful. You have the right to be served. The institution has an obligation to make reasonable adjustments — not to use lack of adjustments as grounds for exclusion.
Constitution of Zambia 1991 (as amended)
Article 23 — Protection from Discrimination
“No person shall be treated in a discriminatory manner on grounds including disability.”
The constitutional prohibition on discrimination applies to disability. File a complaint with the ZHRC — this is a constitutional violation as well as a statutory one.
Persons with Disabilities Act No. 6 of 2012
Section 5 — Zambia Agency for Persons with Disabilities
“The Zambia Agency for Persons with Disabilities (ZAPD) is mandated to promote the rights and welfare of persons with disabilities and to investigate complaints of discrimination.”
File a complaint with ZAPD as well as the ZHRC. ZAPD has specific expertise in disability rights and can recommend or enforce accessibility requirements.
What Scripture Says
God's Word on This
Luke 14:13-14 (NIV)
“But when you give a banquet, invite the poor, the crippled, the lame, the blind, and you will be blessed.”
Jesus specifically named and included those with disabilities in his vision of community and welcome. The biblical model for society is one that goes out of its way to include, not one that excludes based on inability to accommodate. Every exclusion of a person with a disability from public life is a failure of that vision.

You Know the Law — But Do You Know What to Say?
Reading your rights is one thing. Using them under pressure — calmly, correctly, in the right words — is what actually protects you. Members get the scripted rebuttal for this exact situation: what to say first, what to say if they push back, the tone to use, and the constitutional provision to cite. Practise out loud with audio until it's automatic.
