Property Ownership as Justification for Self-Help Eviction

Owning property gives a landlord certain rights — but not the right to evict a resident without a court order. South African law is explicit: no person may be evicted from their home without a court order authorised by a judge or magistrate. This applies whether or not the person is paying rent, whether or not there is a written lease, and whether or not the landlord claims the property is theirs. Changing locks, removing belongings, or using threats to force someone out is an unlawful eviction, regardless of who owns the property.

A verbal notice, a Friday deadline, or a threatening letter is not a court order. The PIE Act requires a formal court process before anyone may be lawfully evicted.
