“My medical aid only covers the scheme rate, but I have gap cover for the difference; please send the claim to my gap provider before asking me to pay this shortfall out of pocket.”
The patient is facing an unexpected bill from a specialist who charges above the medical aid rate. By demanding immediate payment from the patient, the hospital attempts to bypass the patient's insurance rights and force them to carry the financial burden personally.

The Fallacy of Immediate Personal Liability

The provider assumes that because the medical aid did not cover the full amount, the patient is automatically and immediately liable for the balance. This ignores the existence of gap cover as a legitimate financial instrument intended to settle such shortfalls. Legally, the patient has the right to ensure all insurance avenues are exhausted before being held personally liable for the difference.

Medical Schemes Act 131 of 1998
“A medical scheme must pay in full for the diagnosis, treatment and care of Prescribed Minimum Benefit conditions. For other claims a scheme pays only at its scheme rate, and a private specialist may lawfully charge more than that rate.”
Because a specialist may charge above the scheme rate for non-PMB care, you are liable for the shortfall — but you are entitled to claim it from your gap-cover policy before being forced to pay out of pocket.
