What They Said

“This is our culture. You cannot question it. It has been this way for hundreds of years.”
A family member, community elder, or leader invokes tradition to silence any challenge to a practice — using age and cultural identity as the justification for compliance.

Appeal to Tradition

This is one of the most common logical fallacies: the argument that because something has been done for a long time, it must be correct or should continue. The age of a practice does not make it just. Slavery, foot binding, and child marriage were all ancient cultural practices. The length of time a custom has existed is a statement about its history — not about its legitimacy.

Cultural rights are explicitly limited: they cannot override any other right in the Bill of Rights. Culture cannot override dignity, equality, or the rights of children.

“When interpreting any legislation, and when developing the common law or customary law, every court, tribunal or forum must promote the spirit, purport and objects of the Bill of Rights.”
Even customary law must be developed and interpreted in a way that promotes the Bill of Rights. Customary law that conflicts with the Constitution must yield.

“No person may unfairly discriminate on the ground of gender, including any practice, including traditional, customary or religious practice, which impairs the dignity of women and undermines equality between women and men.”
Any cultural or traditional practice that impairs the dignity of women or undermines gender equality is prohibited by statute.

“'You abandon the commandment of God and hold to human tradition.' He also said to them, 'You certainly set aside the commandment of God to maintain your tradition.'”
Jesus directly confronted the use of tradition to override what is right. Tradition held up against truth — including legal and moral truth — is not sacred. It is an obstacle.
Colossians 2:8 (NET)
“Be careful not to allow anyone to captivate you through an empty, deceitful philosophy that is according to human traditions and the elemental spirits of the world, and not according to Christ.”
Human tradition that is not according to Christ — that does not align with his values of dignity, justice, and truth — is described as empty and deceitful.
