Appealing to Suspicion as Legal Justification

The mere existence of suspicion does not constitute a legal basis for entering and searching a home without a warrant. Reasonable suspicion may justify applying for a warrant, but it does not replace one. The right to privacy of the home is one of the most protected rights in many legal systems, and exceptions to the warrant requirement are narrow and strictly defined.

“A house search, that is the search of the dwelling or other rooms belonging to the household, may only be carried out if there is a well-founded suspicion that a person suspected of a crime or misdemeanor is hiding there, or that objects are located there whose possession or inspection could be of importance for a specific investigation.”
The police claim reasonable suspicion justified the search without a warrant. However, under § 139 StPO, a house search is only permissible if there is a well-founded suspicion that a wanted person or relevant objects are present. The law does not mention a warrant requirement, but it sets a substantive condition; the police must have an actual, objective basis for suspicion, not merely a subjective hunch.
