A fuel station attendant is charging you above the gazetted petrol price, claiming it is needed to cover their operational costs. Petrol is sold at a single regulated price, so this surcharge is unlawful and puts you at a financial disadvantage.
The Fallacy
Appeal to Necessity (False Justification)
The operator argues that their business costs justify breaking the law. But petrol is sold at a single price set by the Department of Mineral and Petroleum Resources, which already factors in shipping and operational costs. Charging above the regulated petrol price is an offence, regardless of the station’s own financial pressures.

Section 2(1)(c) — Regulation of the petrol price
“The Minister may prescribe the price at which petrol may be sold. Petrol is regulated at a single pump price nationwide; unlike diesel, which is not regulated at the pump, a retailer may not sell petrol above the gazetted price.”
This makes the petrol pump price a single regulated figure, so any sale of petrol above the gazetted price is a direct violation of the Act. (Diesel, by contrast, is not price-regulated at the pump.)
