The Fallacy
Appeal to Authority / False Finality
The statement presents the committee's authority as absolute and final, creating the impression that no further recourse exists. This is legally false in South Africa, where any administrative decision that adversely affects rights is subject to either internal appeal (where it exists) or judicial review in the High Court. Authority does not equal infallibility or immunity from scrutiny.
What the Law Says
Your Legal Foundation
Promotion of Administrative Justice Act 3 of 2000
Section 6(1) — Judicial review of administrative action
“Any person may institute proceedings in a court or a tribunal for the judicial review of an administrative action.”
The right to approach a court for judicial review of any administrative action is broadly available to any person affected by such action.
Promotion of Administrative Justice Act 3 of 2000
Section 6(2) — Grounds for judicial review
“A court or tribunal has the power to judicially review an administrative action if... the action was procedurally unfair; or the action was taken because of an error of law; or the action was taken in bad faith; or the action is otherwise unconstitutional or unlawful.”
A committee decision made without proper procedure, based on a legal error, or in bad faith is reviewable by a court on these grounds.
Constitution of the Republic of South Africa, 1996
Section 34 — Access to courts
“Everyone has the right to have any dispute that can be resolved by the application of law decided in a fair public hearing before a court or, where appropriate, another independent and impartial tribunal or forum.”
No administrative body — however senior — can strip an individual of their constitutional right to have a dispute resolved by a court.
What Scripture Says
God's Word on This
Deuteronomy 1:17 (NET)
“You must not show partiality in judgment — hear the lowly and the great alike. Do not be intimidated by anyone, for judgment belongs to God. Bring me any case too difficult for you and I will hear it.”
Even human judges and committees are accountable to a higher standard — no earthly ruling body is the final word where justice is concerned.
Amos 5:24 (NET)
“But let justice roll on like a river, and righteousness like an ever-flowing stream.”
Justice is not static or self-contained within committees — it must flow freely, and those who obstruct it by claiming finality stand against this call.
