What to Do Right Now
1Check whether you received a Section 129 notice. This is a written notice from the credit provider. Without it, any repossession attempt is unlawful.
2Within 10 business days of the notice, you can: pay the full arrear amount; apply for debt counselling; or approach the credit provider about a payment arrangement.
3Apply for debt counselling immediately if you cannot pay. Once accepted under debt review, the credit provider cannot repossess or take legal action while the review is in progress.
4If repossession agents arrive without a court order and you have not voluntarily surrendered, they have no right to take the vehicle. Calmly state this and contact Legal Aid or a debt counsellor immediately.
5If a court order has been granted, you can still apply to court to suspend the order if you can bring payments up to date or propose a reasonable repayment plan.
