Direct Answer
If SASSA rejects your disability grant application, you have 90 days from the date of the rejection letter to lodge an appeal with the Independent Tribunal for Social Assistance Appeals (ITSAA). The appeal is free, does not require a lawyer, and is conducted in writing. If ITSAA upholds your appeal, SASSA must approve the grant with backdated payments from the original application date.

Immediate Steps
What to Do Right Now
1Get the rejection letter in writing. If SASSA has not given you a written reason for rejection, request it — you are entitled to written reasons under PAJA.
2Understand the reason for rejection. SASSA typically rejects on medical grounds (disability not severe enough), administrative grounds (missing documents), or income/means test grounds. The appeal strategy differs for each.
3Lodge your appeal online at sassa-itsaa.dsd.gov.za or at any SASSA office within 90 days of the rejection letter date. Attach: ID, the rejection letter, a new or updated medical report from your doctor confirming the disability and its functional impact on your ability to work.
4If the rejection was on medical grounds, get a detailed medical report that specifically states: the diagnosis, the duration (permanent or long-term), and that the disability renders you unfit for work. Vague medical certificates are often the reason for rejection.
5ITSAA will review your appeal on the papers. If the appeal is allowed, SASSA must approve the grant with back-payment from the original application date.
6If ITSAA dismisses the appeal, you can approach the High Court for judicial review under PAJA. Legal Aid SA can assist with this step for qualifying persons.

How long does a SASSA disability grant appeal take in South Africa?
ITSAA is required to determine appeals within 90 days of receipt. In practice, decisions can take 3–6 months. If SASSA fails to pay within a reasonable time after a successful appeal, you can approach the court for a mandamus order to compel payment.
Can I apply for the disability grant again if my appeal fails?
Yes. You can make a fresh application at any time, particularly if your medical condition has worsened or you have new medical evidence. A new application resets the process — the appeal failure does not bar future applications. Your new medical report should specifically address the reason SASSA and ITSAA previously gave for rejection.
What is the difference between a disability grant and a care dependency grant?
The disability grant is for adults (18–60) who are themselves unable to work due to disability. The care dependency grant is for parents or caregivers of children with severe disabilities who require full-time care. A person can apply for both if both criteria are met — though they are separate grants for separate purposes.
Can someone who is HIV-positive qualify for the SASSA disability grant?
Yes, if their HIV/AIDS-related illness causes functional disability that renders them unfit for work. The medical report must document the specific functional limitations, not just the diagnosis. CD4 count or viral load alone is insufficient — the report must describe the impact on the ability to work.
