Does the Labour Act apply to all workers in Nigeria?
The Labour Act primarily covers manual workers and non-management staff. Senior management employees and those in supervisory roles rely more on their individual contracts and common law. All workers, regardless of grade, can file at the NIC for employment-related disputes.
I was dismissed without any reason given — is that legal?
No. While Nigerian law does not require cause in all contracts, the employer must still give proper notice or pay in lieu. A dismissal without notice and without wages in lieu is automatically wrongful.
What if my employer claims I was summarily dismissed for gross misconduct?
Summary dismissal (immediate, no notice) is only lawful for proven gross misconduct — theft, fraud, deliberate sabotage. If the employer cannot prove the misconduct, the dismissal is still wrongful. File at the NIC.
My employer owes me severance or gratuity — how do I claim it?
Gratuity and severance terms depend on your contract or collective agreement. File with the NIC or the Ministry of Labour listing all amounts owed. The court can order payment of all outstanding employment benefits.
