Yes. The Constitutional Court confirmed in Du Toit v Minister of Welfare that same-sex couples have the right to adopt jointly. This was subsequently codified in the Children's Act.
Can I adopt a child from another country in South Africa?
Intercountry adoption is very restricted. South Africa requires all local adoption avenues to be exhausted first. Foreign children can be adopted by South Africans, but the process is governed by both South African law and the Hague Convention.
Does a biological parent's consent to adoption bind them permanently?
Yes — once an adoption order is granted, the biological parents' parental rights are terminated and cannot be revived. Consent can be withdrawn before the order is granted, within 60 days of giving consent.
