Scripture values the body as sacred and the healing arts as God-honoured. Here is the biblical case for healthcare as a right — and how South African law gives it effect.

Faith and healthcare are not opposites in Scripture. Jesus healed. He sent his disciples to heal. He explicitly endorsed doctors. He described his own mission partly in terms of giving sight to the blind and freedom to those who are physically oppressed. The biblical view of the body — as a temple of the Holy Spirit, made in the image of God — creates a strong theological foundation for health rights.

Your body is declared holy — a dwelling of the Spirit. To neglect it, allow others to harm it, or be denied care for it, is a violation of something God declares sacred. Healthcare is not merely a welfare issue; it is a theological one.

The Good Samaritan provided immediate, practical medical care — without asking whether the injured person deserved it or could pay. In South African Law — Section 27 of the Constitution
Section 27 of the Constitution gives everyone the right to access healthcare services including reproductive healthcare. Section 27(3) is absolute: no one may be refused emergency medical treatment. The National Health Act requires all health establishments to provide emergency treatment regardless of ability to pay. Medical negligence can be reported to the HPCSA (012 338 9300). Medical aid scheme disputes go to the Council for Medical Schemes (012 431 0500).

Can a hospital turn me away if I cannot pay?
For emergency treatment — absolutely not. Section 27(3) is a non-derogable right. A hospital that refuses emergency care is in direct violation of the Constitution. Report to the SAHRC and the National Department of Health. For non-emergency care in public hospitals, the means test applies and services are subsidised or free for those who cannot pay.
Can someone refuse medical treatment for a child on religious grounds?
No. Section 28(1)(c) gives every child the right to basic healthcare services. Where a parent refuses life-saving treatment for a child on religious grounds, the Children's Court can order treatment in the best interests of the child. A child's right to healthcare overrides a parent's religious objection in life-threatening situations.
