South African Education Rights (Section 29)

Section 29 of the Constitution guarantees the right to basic and further education. The South African Schools Act prohibits refusal of admission based on inability to pay fees. Section 40 provides for fee exemption on application. Learners cannot be expelled without a proper hearing. Governing body decisions can be appealed to the provincial MEC. My child was told they cannot come to school because we haven't paid fees. Is this legal?

No. Section 5(3)(a) of the Schools Act prohibits any person from preventing a learner from attending school on account of a parent's failure to pay fees. Report this to the provincial Department of Education immediately. The school can claim fees through civil proceedings, not by excluding the learner.

What is the process for a fair expulsion in South Africa?

The Schools Act requires: (1) written notice of the charge to the parent, (2) a hearing by the governing body at which the learner and parent may make representations, (3) a written finding, and (4) the right of appeal to the MEC. Skipping any step makes the expulsion procedurally invalid.

Does language of instruction count as a rights issue in South African schools?

Yes. Section 29(2) gives learners the right to receive education in the official language of their choice where reasonably practicable. Schools cannot simply refuse to accommodate a language request without considering whether it is practicable.
