South African Schools Act 84 of 1996
Section 5 — Admission to public schools
“A public school must admit learners and serve their educational needs without unfairly discriminating in any way. No learner may be refused admission to a public school on the grounds that his or her parent is unable to pay or has not paid school fees.”
A public school cannot refuse admission on grounds that constitute unfair discrimination. 'Area of residence' used as a barrier when it disproportionately affects poorer communities is challengeable.

Section 29 — Education
“Everyone has the right to a basic education, including adult basic education.”
The right to basic education is guaranteed to everyone. A school's internal policy cannot override this constitutional right.
Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000
Section 6 — Prohibition of unfair discrimination
“No person may unfairly discriminate against any person on the grounds of race, gender, sex, pregnancy, marital status, ethnic or social origin, colour, sexual orientation, age, disability, religion, conscience, belief, culture, language and birth.”
If the area-based exclusion policy in practice excludes children based on social origin or economic status, it constitutes unfair discrimination under PEPUDA.
