NSSF (National Social Security Fund)

NSSF is Kenya's mandatory pension and provident fund for workers. Both employer and employee make monthly contributions; benefits include retirement lump sums, invalidity, and survivors' grants.

Legal Definition

The National Social Security Fund is established under the NSSF Act (Cap 258). Under the original Act, contributions were a fixed KES 200/month (employer + employee). The NSSF Act 2013 introduced income-based contributions (6% of gross pay each from employer and employee, capped at prescribed limits) but its implementation has been contested in court. NSSF provides: a retirement benefit (payable at age 60 or 55 for early retirement); an invalidity benefit (permanent incapacity); a survivors' grant (paid to dependants on death of member); a funeral grant; and an emigration benefit (for members leaving Kenya permanently). An employer who fails to register employees, deduct contributions, or remit them to NSSF within the prescribed period commits an offence. An employee can request a NSSF statement at any time to verify their accumulated balance and ensure contributions are being remitted.

📖 Constitutional / Statutory Basis: NSSF Act (Cap 258); NSSF Act No. 45 of 2013

Practical Example

A worker is retrenched at age 55 and wants to access NSSF early retirement benefits. She visits the NSSF office with her national ID, NSSF membership card, and termination letter to apply for early retirement benefits.

Frequently Asked Questions

When can I access my NSSF savings in Kenya?
You can access full retirement benefits at age 60, or early retirement at 55. You can also access benefits on permanent invalidity, emigration, or death of a member (survivors' grant). Partial withdrawals are not generally permitted under the old scheme.
What if my employer has not registered me with NSSF?
Your employer is required by law to register all employees with NSSF. Failure to do so is an offence. You can report the employer to the NSSF enforcement department.
