The National Council on Disability Affairs is an inter-agency body created under Executive Order No. 232. It formulates policies and coordinates programmes for the rehabilitation and development of persons with disabilities (PWDs). The NCDA oversees implementation of: **Magna Carta for Disabled Persons (RA 7277, as amended by RA 9442 and RA 10754)**: Grants PWDs rights to equal opportunity in employment, education, and access to services; 20% discount and VAT exemption on certain goods and services; and protection from discrimination. **RA 10524**: Requires private establishments with 100+ employees to reserve at least 1% of positions for qualified PWDs. **Accessibility Law (BP 344)**: Requires public and private buildings to have ramps, accessible toilets, and other features for PWDs. The NCDA can receive complaints about denial of PWD discounts, inaccessible public spaces, discrimination in employment, and denial of enrolment in schools. Complaints can be filed at NCDA offices or through NCDA regional offices. For employment discrimination, the DOLE also has jurisdiction; for educational access, the CHED and DepEd.
A pharmacy refuses to give a senior citizen with a disability the 20% PWD discount, claiming she does not look disabled. Under RA 7277, refusal to grant the PWD discount to a holder of a valid PWD ID is a violation. The customer files a complaint with the NCDA and the DTI.
