Legal Definition

The Employment Code Act No. 3 of 2019 replaced the Employment Act (Cap. 268) and consolidated Zambia's employment law. It applies to all employees in Zambia regardless of sector. It governs: minimum terms and conditions of employment, written employment contracts, notice periods, severance pay, sick leave, maternity leave, and fair termination procedures. It requires that all dismissals follow a fair procedure — the employee must be informed of the reason and given an opportunity to respond. Disputes go to the Industrial Labour Tribunal.

Practical Example

A Lusaka factory worker is dismissed on the spot for alleged misconduct. Under the Employment Code Act, the employer must give a written notice of the allegations, hold a hearing at which the employee can respond, and only then make a decision. Dismissal without a hearing is procedurally unfair, and the worker can file at the Industrial Labour Tribunal.
