Divorce vs Annulment in South Africa

Divorce and annulment both bring a marriage to an end, but they are legally very different. Divorce dissolves a valid marriage that has broken down; annulment treats a defective marriage as if it was never valid in the first place.

The legal dissolution of a valid marriage that has irretrievably broken down (or, rarely, on the grounds of mental illness or continuous unconsciousness).

Annulment (Nullity)

Can I get an annulment just because the marriage was very short?
No. A short marriage is not a ground for annulment — that would be a divorce. Annulment requires a defect that existed at the wedding, such as bigamy, fraud, duress, or a prohibited-degree relationship.
Is a marriage automatically annulled if my spouse was already married?
A bigamous marriage is void from the outset, so it has no legal effect. But you should still obtain a declaratory court order confirming the nullity, to avoid any confusion about your legal status.
