Community of Property vs ANC South Africa — Matrimonial Property Regimes Explained
If you marry in South Africa without signing an antenuptial contract (ANC), you are automatically married in community of property. Understanding the differences before marriage is crucial — changing regimes afterwards requires a High Court order.
In Community of Property (No ANC)
The default regime. All assets and debts — before and during the marriage — are shared equally in a joint estate.
When it applies: No ANC was signed before the marriage. This applies automatically.
